1. Acceptance of Terms
By accessing the Park Road Photo website (parkroadphoto.biz) or booking a service, the "Client" (Listing Agent, Homeowner, or Brokerage) agrees to be bound by these Terms and Conditions. These terms constitute a binding contract between the Client and Park Road Photo ("The Agency").
2. Scope of Services
Park Road Photo provides professional real estate media services, including high-resolution interior/exterior photography, aerial drone imaging, videography, virtual tours, and floor plans. The specific deliverables for each project are defined by the package selected at booking.
3. Delivery & Turnaround Time
We pride ourselves on efficiency without compromising quality.

Photography: High-resolution images will be delivered within two (2) business days of the shoot.

Videography: Final edited video cuts will be delivered within two (2) business days of the shoot.

Virtual Tours: 3D tours and floor plans are processed and delivered within 72 hours (3 business days) unless otherwise noted.

Note: Turnaround times may vary during peak seasons or for custom commercial projects; any deviations will be communicated in advance.
4. Fees & Payment Policy

Invoicing: An invoice will be generated upon completion of the shoot.

Payment Requirement: Full payment is required to release the final downloadable files. Preview images may be sent for review, but high-resolution assets are locked until the invoice is satisfied.

Refunds: Due to the custom, digital nature of our work, all sales are final. Park Road Photo does not offer refunds once services have been rendered. In the event of artistic dissatisfaction, we will work reasonably with the Client to correct the issue (e.g., a re-edit).
5. Cancellation, Rescheduling & Site Access
Your appointment time is reserved exclusively for you.

24-Hour Notice: Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled start time.

Late Cancellation Fee: Cancellations made with less than 24 hours' notice are subject to a fee of $75.

Site Readiness: The property must be "photo-ready" upon the Photographer’s arrival. For liability reasons, Park Road Photo staff will not move furniture, clean messes, or stage rooms. If a property is not ready, the Photographer may shoot "as-is" or charge a delay fee.

Weather: We do not charge for rescheduling due to hazardous weather (heavy rain, high winds). Overcast skies do not constitute hazardous weather.
6. Rights, Usage & Copyright

Copyright Ownership: Park Road Photo retains all copyright and ownership of all media created.

Usage License: Upon full payment, the Client is granted a License to Use the media for all marketing associated with the sale or lease of the subject property (MLS, social media, print flyers, brokerage website).

Term: This license is valid for the duration of the listing.

Non-Transferable: This license is non-transferable. The Client may not sell, give, or sub-license the media to third parties (including builders, stagers, designers, or architects) without written permission from Park Road Photo. Third-party licensing is available for an additional fee.
7. Model & Property Release
Unless a Non-Disclosure Agreement (NDA) is signed prior to the shoot, the Client grants Park Road Photo the irrevocable right to use the images for our own company self-promotion (e.g., portfolio, website, social media, and marketing materials).
8. Liability & Indemnification

Property Risk: Park Road Photo is not liable for minor property damage (e.g., scuffs, knocks) that may occur during the normal course of photographing a property, nor for any injury sustained by individuals on the premises.

Indemnity: The Client agrees to indemnify and hold Park Road Photo harmless against any claims, damages, or liabilities arising from the use of the images or the Photographer’s presence on the property.
9. Dispute Resolution
In the unlikely event of a dispute, both parties agree to first attempt good-faith negotiation. If unresolved, the parties agree to binding mediation within the State of Texas.
